1. Ownership and Operation

Echo Customer AI is owned and operated by Quantinfini AI Private Limited.

2. Definitions

• Platform: Refers to Echo Customer AI’s software, services, website, APIs, and related assets.
• User: Any entity accessing or using the Platform.
• Simulation Output: Behavioural, predictive, or analytical data generated via AI simulations.
• Services: Features and functions offered by Echo Customer AI through the Platform.
• Content: Any input, output, reports, visualisations, or media handled within the Platform.
• Third-Party Products: Tools or services integrated with or referenced by Echo Customer AI.

3. Privacy and Use of Data

• Echo Customer AI is committed to protecting user privacy and handling data in accordance with applicable data protection laws, including the Digital Personal Data Protection (DPDP) Act and relevant international standards.
•  User data is collected and processed solely for the purpose of providing, maintaining,
  and improving the Platform and its Services.
•  Personal data will not be sold or shared with unauthorised third parties. Data may be
  shared with trusted service providers strictly for operational purposes, subject to
  confidentiality obligations.
• Users retain ownership of their uploaded data. By using the Platform, users grant
  Echo Customer AI a non-exclusive, royalty-free licence to use, process, and analyse
  data as necessary to deliver and enhance the Services.
• Echo Customer AI implements industry-standard security measures to protect user
  data from unauthorised access, disclosure, or loss.
• Users may request access to, correction of, or deletion of their personal data, subject
  to legal and contractual obligations.

4.Use of Services and Content

• Users agree to use the Services strictly for lawful, permitted purposes.
• Users may not reverse-engineer, tamper with, or misuse simulation outputs.
• Echo Customer AI may suspend access in case of data manipulation, algorithmic gaming, or unethical profiling.

5. Third-Party Products and Services

• Echo Customer AI may integrate with or recommend third-party products.
• Echo Customer AI is not responsible for the performance, data use, or compliance of such third-party offerings.
• Use of third-party products is governed by their own terms and policies.

6. Fees and Payment

• Subscription fees, billing cycles, and applicable taxes shall be disclosed via the
  Platform or invoice.
• Payments shall be made in INR via authorised payment channels.
• Non-payment may result in account suspension or termination.

7. Proprietary Rights and Licences

• Echo Customer AI owns all rights to the Platform, including software, algorithms, andsimulation logic.
• Users retain rights to uploaded data but grant Echo Customer AI a non-exclusive, royalty-free licence to use, process, and improve the Services.
• Users may not use Echo Customer AI intellectual property to build competitive products.

8. Confidentiality

• Both parties agree to protect confidential information exchanged during usage or commercial engagement.
• Confidential information includes but is not limited to business plans, algorithms, source code, and proprietary data.
• Disclosure to third parties is prohibited unless legally mandated or contractually agreed.

9. Representations, Warranties, and Disclaimers

• Echo Customer AI is legally registered in India and authorised to offer AI-based services.
• The Platform will function substantially as described, but outcomes may vary.
• Disclaimer: Services are provided “as-is.” Echo Customer AI disclaims all warranties, express or implied, including fitness for a particular purpose. Simulation results are directional and not prescriptive; user discretion is advised.

10. Indemnification

• User Indemnity: Users will indemnify Echo Customer AI against claims arising from misuse, unauthorised access, or breach of law.
• Echo Customer AI Indemnity: Echo Customer AI will indemnify users against third-party claims relating to IP infringement caused by the Platform’s core algorithms.

11. Limitation of Liability

• To the maximum extent permitted under law, neither party shall be liable for indirect, incidental, or consequential damages.
• Echo Customer AI’s aggregate liability shall be limited to the total fees paid by the user in the last six months.

12.Term and Termination

• These Terms commence upon acceptance and continue until terminated by either party.
• Termination may occur for breach, non-payment, or misuse.
• Upon termination, access will be revoked and relevant data retained or deleted in accordance with legal obligations.
